Eligibility and account responsibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. You are responsible for maintaining the confidentiality of your credentials, devices, and account activity. Provide accurate information, promptly update it if it changes, and notify us promptly at [email protected] if you believe your account has been accessed without authorization.

Limited license and service changes

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for lawful, non-commercial purposes. The Service is evolving. Features may change, fail, be removed, or become unavailable at any time, with or without notice. We may impose reasonable limits on use, storage, or features.

Shared spaces and your content

You retain the rights you have in content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, and display that content solely as necessary to operate, secure, maintain, improve, and provide the Service. You represent that you have all rights, permissions, and lawful bases needed to submit content and invite or connect others. You understand that content shared with a connected member may remain available to that member as permitted by the Service, even if a relationship changes. We do not verify a user's identity, relationship status, authority, availability, consent, or intent.

Acceptable use

You may not use the Service to violate law; infringe rights; harass, threaten, stalk, exploit, deceive, or endanger another person; submit unlawful, harmful, sexually exploitative, or infringing content; invade privacy; send spam or unwanted invitations; interfere with security or operation; scrape, reverse engineer, probe, or overload the Service; impersonate others; or attempt unauthorized access. We may investigate violations and suspend, restrict, remove content from, or terminate access to the Service.

No emergency, consent, or professional reliance

The Service is a convenience and coordination tool, not an emergency, medical, safety-critical, legal, financial, relationship-counseling, or professional service. A plan, invitation, availability indication, reminder, response, or notification does not establish consent, commitment, attendance, availability, safety, or any agreement between people. You are solely responsible for communicating directly with others, confirming plans, obtaining consent, attending events, and making decisions based on your own judgment.

Third-party services and links

The Service may authenticate through, display, integrate with, or link to third-party services, websites, products, or gift items. We do not control, endorse, guarantee, or assume responsibility for them. Your use of third-party services is governed by their own terms and privacy policies, and you assume the risks associated with any transaction or interaction with them.

Intellectual property and feedback

The Service, including its software, design, trademarks, content provided by us, and related intellectual property, is owned by us or our licensors and is protected by applicable law. Except for the limited license above, no rights are granted to you. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation to you.

Suspension and termination

You may stop using the Service at any time and may request account deletion in Settings or at [email protected]. We may suspend or terminate access, remove content, or discontinue all or part of the Service where reasonably necessary to protect the Service, users, providers, or our rights; comply with law; investigate suspected violations; or for operational reasons. Sections that by their nature should survive termination will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR RESULTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT A PARTICULAR TIME, OR THAT CONTENT WILL NOT BE LOST, ALTERED, OR DISCLOSED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYS FOR US AND ITS AFFILIATES, OFFICERS, EMPLOYEES, PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OPPORTUNITIES, OR RELATIONSHIPS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Days for Us and its affiliates, officers, employees, providers, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your content, your use or misuse of the Service, your violation of these Terms, or your violation of another person's rights.

Changes and disputes

We may modify these Terms by posting an updated version and updating the effective date. Continued use after the effective date means you accept the update to the extent permitted by law. Before filing a claim, you agree to contact [email protected] and give us a reasonable opportunity to resolve the concern. Nothing in these Terms limits rights that cannot legally be waived.
